_... __ III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />- - during the ir.~pection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />T~soil <br />The eastern perimeter of the South Area pit at the location of NOV CV-2001-002 was inspected. <br />Rills and gullies that had formed near the upper portion of the slide area have been repaired. <br />Vegetative cover is improving and the entire slide area appeazs to have stabilized. <br />Additional topsoil is being placed in a small area located on the northeastern side of the former B <br />Pit. Sufficient topsoil depth was not initially redistributed at this location. Vegetative cover has <br />been established, but primarily on spoil material. Additional topsoil will be redistributed in a <br />relatively small area at this location. SCC indicated that transplanting shrub clumps might also <br />be considered for this location. <br />Fish & Wildlife <br />During this inspection, DMG and OSM personnel reviewed SCC's permit application package to <br />determine if SCC is in compliance with applicable requirements for the protection and <br />enhancement of wildlife and wildlife habitats (Rules 2.05.6(2) and 4.18). Tab 11 of the PAP <br />contains appropriate wildlife baseline studies and Tab 23 contains an adequate fish and wildlife <br />plan. SCC has developed a mitigation plan based on the results of the baseline studies and <br />consultation with the Colorado Division of Wildlife and the U.S. Fish and Wildlife Service. The <br />inspection team verified that applicable performance standazds are being complied with. Certain <br />measures inspected on the ground included raptor protection on powerlines and fencing design <br />that should not inhibit big game movement. <br />Reveeetation <br />Houndstongue was noted at several of the sedimentation pond embankments and Canada thistle <br />was present at all sediment pond locations. Please continue to control the growth of troublesome <br />weeds throughout the mine site. <br />
