III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations <br />made during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />This was a complete inspection conducted by Tom Kaldenbach and David Berry of the Colorado <br />Division of Minerals and Geology. Forrest Luke represented the operator on Monday and <br />Tuesday; Karl Koehler represented the operator Wednesday afternoon along with Forrest Luke. <br />The ground was dry. The mine area still showed many of the effects of the 2.2 inches of rain <br />that fell on Trapper September 18 and 19. As requested by the Division in last month's <br />inspection following the rain, Trapper provided the Division with a written storm damage <br />assessment and repair schedule. This document is described below in the comments on <br />sedimentation ponds. Repair work was in progress during the inspection. <br />AVAILABILITY OF RECORDS <br />All required records were on site (please refer to the attached records checklist). <br />SIGNS AND MARKERS <br />Mine ID signs and blasting notice signs were at the proper locations and displayed the proper <br />information. Permit boundary signs and topsoil markers were also properly displayed. The <br />need for placing mine ID signs at the gate leading into the permit area at the new West Flume <br />pond was discussed. The operator is considering eliminating the need for ID signs at that <br />location by replacing the gate with fencing. <br />ROADS AND HYDROLOGIC BALANCE <br />Roads <br />Haul Roads. All haul roads and their embankments were in good condition. <br />Access Roads. All access roads were in good condition with one exception: a headcut next to <br />the south end of AR-10 (leading to Grouse pond) needs repair. <br />Light-duty Roads. The road leading to Oak Gulch was severely gullied in the September 18-19 <br />rain and was impassable, but it has since been repaired. The road leading to Ute Pond is still <br />gullied and needs regrading but is passable. The operator has repair work scheduled for field <br />season 1998. All other light-duty roads were in good condition. <br />Ditches <br />All road ditches appeared to have design capacity and are in good condition. Contour ditches in <br />the upper part of Johnson drainage appeared stable, with one exception: the contour ditch <br />above stock tank JE6 is incised more than 6 feet and is breached at one point. Repair options <br />were discussed. All other contour ditches were in good condition. The diversion ditches that <br />drain to Deer and Ute ponds were in good condition as were diversion ditches in West Buzzard, <br />East Buzzard, and No Name drainages. Elk diversion ditch #1 on the slope directly above the <br />pond is functioning but could use better definition and seed. <br />Page 3 <br />
