III. COMMENTS - COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />This was a complete inspection and a Phase II bond release inspection. CDMG received a <br />Phase II bond release request from Trapper on October 6. 1999. CDMG found the application <br />complete on October 19. 1999. The file number is SL-2. The request is for release of <br />Phase II liability on 319.5 acres. No reduction in the surety amount was requested. <br />A complete inspection is an on-site review of a permittee's compliance with all permit <br />conditions and requirements (Section 5.02.2(2)) A bond release inspection is conducted <br />to evaluate a permittee's reclamation work (Section 3.03.2(2)). <br />A Phase II bond release occurs when the permittee has established vegetation which supports <br />the approved postmining land use and which meets the approved success standard for cover <br />(Section 3.03.1(2)(b)). The lands proposed fora Phase II release cannot be contributing <br />excessive sediment outside the permit area (DMG's "Guideline Regarding Selected Coal Mine <br />Bond Release Issues" dated April 18. 1995, page 5). and damages to prime farm land or <br />alluvial valley floors must be mitigated (Section 3.03.1(3)(b)). <br />Tom Kaldenbach of CDMG conducted the inspection. Forrest Luke and Karl Koehler represented <br />the operator. During the bond release portion of the inspection. Randal Pair represented <br />the USDOI Office of Surface Mining and Rob Erntz represented the USDOI Bureau of Land <br />Management. <br />The ground was dry and the weather was warm. The mast recent precipitation at Trapper was <br />a rain shower that occurred about 10 days earlier. Vegetation has turned brown. <br />Draglines were in operation in D, F,and A pits. <br />AVAILABILITY OF RECORDS <br />The records checklist is attached. All required records were available in Trapper's <br />office. <br />SIGNS AND MARKERS <br />Mine i.d. and blasting warning signs were properly displayed at public entrances to the <br />permit area. Permit boundary markers and topsoil markers were displayed at the numerous <br />locations inspected. <br />ROADS <br />The surfaces of haul roads. access roads, and light duty roads were in good condition. <br />Haul road embankments and cut-slopes showed minimal erosion. Ditches next to roads <br />appeared to have design capacity. <br />
