III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments inGude discussion of observations <br />made during the inspection. Comments also describe any enforcement actions taken during <br />the inspection and the facts or evidence supporting the enforcement action. <br />On March 21 through 24, a complete inspection was conducted at the New Elk <br />Mine. Conditions were generally clear and very windy with a cooling trend toward <br />the end of the week. March has been a dry month and the ground was dry. <br />RDA <br />The upper area diversion was walked around the RDA. This new diversion <br />replaces a lower diversion as the waste pile is build up. Slopes on the outface are <br />at a 2:1. and benched in 50 feet levels. The lower slopes were well vegetated <br />except for the benches where vehicles have driven on the vegetation. <br />Piezometers have been installed on the benches to monitor water levels for pile <br />stability. The conveyor was walked and no concerns were noted. The diversion <br />showed no indication of carrying water. This ditch was Gear from fallen rocks. <br />Five of six conveyors were lined up on the west side of the refuse pile. Currently <br />a loader, a truck and a dozer were working the pile. There were a few wet spots <br />noted in the pile. The east rock gabion was walked down to the pond. In some <br />sections the river rock had shifted downhill and bunched up at the end of each <br />Reno Mattress. Some mattresses appeared to have lost some rock. These <br />sections should be repaired as soon as possible. This probably occurred during <br />the 10 year 24 hour event last year. There were other sections that have rusted <br />wire baskets that may need replacing in the future. A crossing of wood cribbing <br />had been placed across the drainage to allow maintenance equipment to cross <br />without damaging the channel. This should be removed when not used in order <br />to keep the channel at full capacity. General maintenance will be required on <br />both east and west gabions to make sure all sections will work effectively. <br />
