Total area of off-permit disturbance on BLM land wee measured to~lSe 2.2 acres. The <br />total area of all off-permit disturbance ie 4.9 acres, more or lase. ~ ~ - <br />At this point, the lessee, Columbine Paving, has been identified by BLM a d CDOH as the party <br />responsible for cleanup of the contamination and vacating the governme t land. Columbine <br />appears willing to cooperate in working toward a solution to use or leg lly dispose of the <br />contaminants on the entire site, pursuant to the authority of the Colo De t of Health and the <br />County. This cleanup will also serve to remove all operations which are ited ae trespassing <br />on BLM land. However, ae the permittee, Schmalz Construction is ultimat ly responsible for <br />any off-permit damage and permit violations, pursuant to the Minerals R lee and Regulations <br />and the Nined Land Reclamation Act. Therefore, during and of r all this, the <br />permittee/operator must work to get and stay in compliance with the laws nd rules, under the <br />jurisdiction of this Division. <br />Because offeite disturbance was observed, this will be treated se a poeelible violation, and <br />will be brought before the Mined Land Reclamation Board. Please see th~ last page of this <br />report for the explanations of problems and possible violations, an their corrective <br />actions. <br />It ie felt by this inspector that the current bond is not sufficient.
