III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />On August 27, ]996, William J. Carter of the Division of Minerals and <br />Geology conducted a partial inspection of the Hawks Nest Mine. Due to the <br />fact that this a bond forfeiture site there was no operator representative <br />present. <br />Sins and Markers: <br />Two of the stream buffer zone signs are damaged. These signs are missing <br />only part of their right side. <br />Mine and permit identification signs at both ends of the site are in good <br />condition and readable. <br />Roads: <br />Old State Highway 133 is paved and in excellent condition. <br />Hydrologic Balance: <br />There are two seeps, one on each side of the location of the East Mine Portal, <br />These seeps are active enough that both have well established wetland plants, <br />including Broad-Leaved Cat-Tail (T~{ia latifolia ). <br />Backfill and Gradin>;: <br />Both the East and West Portals appear to be stable and do not show signs of <br />settling at this time. <br />The lower bench of the East Mine area is showing signs of erosion. It appears <br />that a few bales of straw would be adequate to control the erosion in these <br />areas at this time. <br />This same bench area, below the East Portal, consists of soils that are very <br />hard. This area might be considered for the addition of some type of soil <br />amendment to aid in establishing a reasonable vegetative cover. It is also <br />recommended that this area undergo soil testing to determine if other <br />problems are present, <br />Support Facilities: <br />The same small pile of trash, ("scrap metal and concrete rubble") is present <br />that was identified in the previous inspection report. <br />Page 1 of 2 <br />
