I will respond to ithe <br />four concerns addressed in the inspection report dated Mazch 10, 1998. I will address' each <br />in the order presented in the report. <br />1. SETTLING POND ROAD <br />Review of Map Exhibits C & F1 dated June 1977, and Map Exhibits C & Fl dated <br />December 1985 show roads in Stage Z. Internal pit access roads during minin are <br />not shown because their exact location is unknown. Map Exhibit F-1 shows w~at <br />roads will be left when reclamation is complete in this stage. A road is part of'the <br />approved plan so no revision is needed. <br />2. WASH PLANT SETTLING POND <br />The plant site is located in Stage W and was added to the area during the permitting <br />process in 1977. The settling ponds are located in Stage Z. In the 1977 application <br />book on page 9; 11 lines from the bottom we explained that Stage Z was previously <br />mined and would be backfilied during the life of the mine. We noted that the area <br />south of the river had been "potholed" pre-law. The original permit maps shoal this <br />area as the western edge of the Stage 2 lake. What is causing confusion is that,the <br />road is on land that will be mined once mining is done in that stage. The road 'serves <br />as a dam to keep silt from entering the lake azea. When the road is mined, the final <br />slopes will be along the edge of the silted azea. I do not believe an application <br />revision is necessary since mining this area in the permit. <br />3. SPILL PREVENTION PLAN <br />On September 30, 1996 an Oil Inspector from the Colorado Department of Labor and <br />Employment visited this site to review operation of the above grown tanks. Tt1ey <br />had no concerns about the operation of the tanks and made no mend about neieding <br />Spill Prevention Plan. Since they are the jurisdictional agency, Whi, water foil; ws <br />.~ <br />
