III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This was a complete inspection conducted by Kent Gorham of CDMG. This former underground <br />mine is reclaimed. Remaining buildings and structures are approved to remain as permanent <br />structures. Ground conditions on this day were dry and the weather was mild. Mr. luppa, the <br />landowner, was not at home during the inspection. <br />Availability of Records <br />The public copy of the mine records is kept at the Las Animas County Courthouse in the Clerk and <br />Recorders Office. A copy of the permit application was located and had been updated through <br />TR-21. Other records were found in manila envelopes and in two three-ring binders, separated by <br />subject. The insurance certificate was valid through 10/112002. Second quarter records for the <br />refuse pile inspection, pond inspection, surface and ground water monitoring, and DMR s were not <br />found. Please update these records immediately. DMG inspection reports for June, July, and <br />August 2002 were also not found. Complete results of the records inspection can be found on <br />page 2a of this report. <br />Hydrologic Balance <br />Contour furrows on the reclaimed refuse <br />slope as noted in last months report.
