III. COMMENTS-COMPLIANCE <br />Below are comments on the inspection. the comments include discussion of observations made during the inspection. Comments <br />also describe any enforcement actions taken during the inspection and the facts of evidence supporting the enforcement action. <br />Pit (Photograph 21) has been backfilled but not graded (see especially Photographs 23 and 26). <br />This is the area that has been backfilled to elevations above approved final topography <br />(temporary storage). The north-south oriented Section 16 Pit remains open (Photographs 21 and <br />22) pending development of future mining plans and potential revised final topography plans. <br />Back-casting is observed in the West Pit in Photographs 31 and 32. The West Pit Excess Spoil Fill and <br />pile are shown in Photograph 33. <br />EXPLOSIVES Holes drilled in preparation of blasting can be seen in Photographs 21, 22 and 24 in the <br />Section 16 Pit. Those hole shown in Photographs 24 and 25 appear to be in the Section 17 areas of <br />the operation. <br />SUPPORT FACILITIES The shops, field office, and storage areas appear in Photograph 36. The new <br />modular office building is up. Revised Drawings 22 and 38 have not been submitted to show this <br />building as of the date of this report. This building is identified as a "Proposed Administrative Office" <br />on page D-18 of Appendix 13 in the Permit Application Package. See the Hydrologic Balance <br />section for references to photographs of ponds. The loadout area is shown on Photograph 38. The <br />crushed coal stockpile areas (2 each), the secondary crusher, the train crushed coal stockpile, <br />portions of the rail loop, and the stoker loading area are clearly shown. <br />TOPSOIL An area of recent placement of topsoil is visible in Photographs 9, 10, 12 and 13. Depths <br />of placement were measured and validated during the inspection of September 12, 2001 (see <br />Photographs 19-01-09-13-1778 through 180g). Salvage of topsoil and windrowing of topsoil in the <br />Section 17 portion of the Section 16 Pit appears in Photographs 24 and 25. Clearing and grubbing <br />in advance of the West Pit is seen in Photographs 30 and 31. Spreading of topsoil near the west <br />end of the West Pit initial cut can be seen in Photographs 33 and 34. Topsoil Pile 15A is <br />predominate in Photograph 36. <br />GENERAL MINE PLAN COMPLIANCE Active operations are observed in the East, West and Section <br />16 Pits. See Backfilling above. Photograph 14 is an overview of the East Pit. The initial cut <br />connecting the West Pit into the East Pit can be seen on Photographs 18 and 31. Photograph 27 is <br />an overview of the West Pit. The remaining north-south opening of the Section 16 Pit can be seen in <br />Photograph 22. The East Pit and the north end of the Section 16 Pit are shown in Photographs <br />28.and 29. The East Pit and the West Pit cut to the East Pit appear in Photograph 30. Photographs <br />32, 34 and 35 are overviews of the West Pit. <br />REVEGETATION Portions of revegetated areas appear in all photographs except for the following: <br />5, 7, 1 1, 23, and 38.
