III. COMMENTS-COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the inspection. Comments <br />also describe any enforcement actions taken during the inspection and the focis of evidence supporting the enforcement action. <br />Carry-over items of concern from previous inspections: A revision is required to the Permit <br />Application Package to post personnel changes at Colowyo Coal Company, L.P. (inspection <br />report of 12 Sep Ol). The new field office building needs to be included on Drawings 22 and 38 <br />(inspection report of 12 Sep Ol ). <br />These two items have not been resolved as of the date of this report. A summary of items of <br />concern or of interest developed as a result of this inspection include: <br />1) The appearance of damage to the permanent perimeter ditch in the vicinity of E1359000 <br />N347100 (north side of East Pit reclamation, west of Streeter Fill). <br />2) Corrections to Drawing 12, revised 5/30/01, appear to be warranted. What appears to be a <br />collection ditch in Photograph 8, from the Gulch A ravine towards the north and tying into the <br />ditch feeding into the Streeter drainage collection system, does not appear on the Drawing. If <br />appropriate, please add this ditch, labeled, to Drawing 12. In addition, please label, on <br />Drawing 12, the 3300-foot ditch towards the Streeter drainage collection system, and the main <br />relief drain (7900-foot ditch) off the Gulch A water shed to the Gulch A pond. <br />This aerial inspection report is prepared by Byron G. Walker from 38 aerial photographs (numbers <br />19-01-10-11-1(1) through 38 (38) on file at the Division) taken on October 11, 2001 by, and an oral <br />debriefing of, Mr. Harry Ranney, Environmental Protection Specialist of the Division. Mr. Ranney <br />stated that he saw no problems at the site. Copies of the aerial photographs have been provided <br />to Colowyo Coal Company, L.P. by e-mail. <br />HYDROLOGIC BALANCE Water appears in Streeter Pond (Picture 4). Some water appears to be in <br />the Gulch A pond. Cleaning operations are underway at the Gulch A pond. (Pictures 5, 7 and 8). <br />Corrections to Drawing 12, revised 5/30/01, appear to be warranted. What appears to be a <br />collection ditch in Photograph 8, from the Gulch A ravine towards the north and tying into the <br />ditch feeding into the Streeter drainage collection system, does not appear on the Drawing. <br />Labels are missing on Drawing 12 for the 3300-foot ditch towards the Streeter drainage collection <br />system, and the main relief drain (7900-foot ditch) off the Gulch A water shed to the Gulch A <br />pond. Water appears in the Section 16 Pond (Photograph 20). Water is apparent in the East Taylor <br />Pond (Photographs 33, 34 and 35). Water appears in the Washbay Sediment Sump, the Washbay <br />Pond, the Work Area Sediment Pond, the Aeration Pond, and a small amount in the north <br />Evaporation Pond in Photograph 36. A small amount of water appears in the upper cell of the <br />West Pit Pond in Photograph 37. Water appears in the Gossard Pond and the Loop Pond in <br />Photograph 38. <br />BACKFILLING AND GRADING Backfill of the East Pit by a dragline (back-casting) can be seen in <br />Photographs 9, 10, 11, 14, 15, 17 and 18. Planned re-disturbance of an area of previously graded <br />Section 16 is observed in Photographs 10 and 1 1. Dragline back-casting in the Section 16 Pit can <br />be seen in Photographs 16, 19, 21, 22 and 23. The area north of the east-west-oriented Section 16 <br />Page 3 of _6_ Pages.
