The Gleason Pit is approved <br />for 8.0 acres affected area. DMG holds 512,000 financial warranty. Operations were active. <br />Permit History The original 110c permit was issued on January 30, 1984, to Montrose County, for 8.0 acres <br />affected area. On January 4, 1994, DMG approved SO-01, for Farmer's Construction Company, Inc., as <br />successor operator, financial warranty was submitted in the amount of S12,000. <br />Permitted Acreage Confusion exi:;ts in the records concerning the permitted acreage and configuration of <br />the permit boundary. The permit application form and permit issuance document indicate that the permit is <br />approved for 8.0 acres affected area. However, the map exhibit submitted with the original permit application <br />indicates that the permit area is 600' x 600' or 8.26 acres. The map submitted by Montrose County with the <br />SO-01 application, indicates that tFie permit area is 660' x 660' or 10 acres. Annual reports, submitted by <br />the original operator and the current operator, have indicated the permit area to range from 8 to 10 acres. <br />However, DMG records do not indicate that either the original operator or the current operator has <br />appropriately requested to enlarge the permit acreage or modify the configuration of the permit boundary. <br />Therefore, DMG records indicate that the Gleason Pit permit is approved for 8.0 acres affected area. Please <br />submit professional quality, scaled map(s), showing all areas affected by the mining operation and the <br />approved permit boundary. The submitted maplsl must be prepared and signed by the registered land <br />surveyor, professional engineer, or other qualified person who created the map, and satisfy all applicable <br />requirements of Rules 6.3.5 and 6.2.1 . <br />Should the operator desire to modify the configuration of the permit boundary or increase the permitted <br />acreage, such requests are submitted through the appropriate Technical Revision, Amendment, or Conversion <br />processes described in Rules 1.1(6), 1.1(49), 1.9, 1.10 and 1.11. Failure to secure DMG approval of <br />modification of the permit area boundary or increase in affected area prior to commencement of mining <br />activities in off-permit areas may result in enforcement action with associated civil penalties. Please review <br />Rule 3.3 and C.R.S. 34-32.5-123 and C.R.S. 34-32.5-124. <br />Signs & Markers The mine identification sign, required by Rule 3.1.12(1), was posted at the mine entrance. <br />However, permit boundary markers, required by Rule 3.1.12(2), were not observed. <br />Notice to Increase the Financial Warranty DMG has reviewed the current cost of reclamation and has <br />determined that the existing 512,000 financial warranty is not sufficient to ensure reclamation.
