TRANSIT MIX AGGREGATES <br />CASTLE AGGREGATES <br />May 2, 2003 <br />TRANSIT MIX OF PUEBLO AGGREGATES <br />Mr. Berhan Keffelew <br />Division of Minerals & Geology <br />1313 Sherman Street <br />Room 215 <br />Denver, CO 80203 <br />Dear Mr. Keffelew, <br />RECEIVED <br />MAY 0 5, 2Q03 <br />Division aI Minerals and Geology <br />I appreciate the time you took to tour our Transit Mix of Pueblo-West Pit, permit number M- <br />1977-573, on April 3Q 2003. <br />DANIELS SAND <br />As you are probably aware of, Transit finished the final reclamation of the Divelbiss and Litvak <br />portion of the permit in late 1996 and eazly 1997. Transit has made a diligent effort to comply <br />with all the State's requirements related to the reclamation of this azea. We initially seeded this <br />area in early 1997 and reseeded it in the eazly spring of1999 with seed mixture recommendations <br />from the county soil conservationist. Additionally, Transit began a weed control plan in the <br />spring of 2002 through spraying and did so again in eazly 2003. Transit has mowed the weeds <br />during the summer as well. <br />Three significant factors, beyond the control of Transit, have primarily prevented Transit from <br />accomplishing the requirements of the DMG. An individual, Divelbiss, has a recreation right on <br />this part of the mining permit. He does not believe he is bound by the State's rules related to <br />reclamation. He has entered and ultimately destroyed approximately one half of [he reseeded <br />acreage against the will of Transit. Without court action, it does not appear that Transit can <br />prevent him from entering. Secondly, the drought, which began approximately in 2000, has <br />curtailed growth. Finally, [he control of noxious weeds is futile, because all of the surrounding <br />property of the site is not bound to control the weeds. Transit's efforts are offset with the weeds <br />migrating from the property that we have no control over. <br />After six years of sincere effort to reclaim the land per [he guidelines of the State, but limited due <br />to the aforementioned factors, Transit should be granted release in this area of [he permit. <br />Transit's site appears as good as the surrounding terrain that has never been disturbed. <br />One additional fact is that the landowner, Valco Inc. and the permittee, Transit are in negotiations <br />with the Colorado State Parks Department for transfer of ownership of [his part of the permit. <br />The Parks department could determine the final use of [his area. <br />I request that you factor these mitigating circumstances into your decision and grant Transit Mix <br />of Pueblo partial release of the Transit Mix of Pueblo-West Pit, Number M-1977-573. <br />Sincerely, <br />Jf erry Hermann <br />Vice President <br />CASTLE P.0.
