III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a complete inspection of the Yoast Mine conducted on May 14, 2007 by Mike Boulay <br />of the DRMS. Roy Karo of Seneca Coal Company was present during the entire inspection. <br />Ground conditions were dry throughout the mine site and it was sunny and warm during the <br />inspection. The only activity at the mine during the inspection was in the former neck pit area <br />where scrapers were hauling topsoil from Topsoil Pile K and one dozer was working to <br />redistribute and spread the topsoil at the neck pit. <br />Roads <br />Haul Roads A and the remaining portion of Haul Road B were dry and well maintained. Road <br />ditches and road drainage runouts along these sections of haul road were dry and functional. <br />Culverts along Haul Roads A and B were clear of sediment and debris and functioning properly. <br />Former Haul Road D area was inspected. The road has been entirely reclaimed and the location <br />is stable. The Light-Use Road accessing the North pit was dry and in fairly good condition. <br />Some areas of this road have become rutted, but the road is passable. SCC has indicated that <br />they will be reclaiming the road into the North Pit. <br />Hydroloeic Balance <br />Sedimentation Ponds 010, 011, O11A, 012, 013, and 014 were inspected. Ponds 011A, 013, and <br />014 were retaining significant amounts of water but not dischazging. Ponds 010, 011, and 012 <br />were full and dischazging cleaz water. A rill/gully has formed along the side of PM-9 near the <br />inlet to Pond O11A. This should be repaired before it becomes a deeper gully. Some repair will <br />also be needed near the bottom of the channel/inlet to Pond 012 where a portion of the channel <br />has eroded. A small slump is also evident south of the inlet. Inlets, embankments, and dischazge <br />structures at all other pond locations were stable and no other problems were noted. <br />The newly constructed stock pond ST-1 was inspected. The stock pond does not appear to be <br />retaining water very well probably due to its location on regraded spoil material. <br />The Lower Armand Draw drainage has held up well. There is significant mud build up in front <br />of the dams but they aze functioning as intended. There was running water through the dams at <br />the time of the inspection. It maybe necessary to clean the check dams again and at some point <br />in the near future and reseed the drainage channel bottom. <br />
