III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations <br />made during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />This was a partial inspection conducted by Tom Kaldenbach of the Colorado Division of Minerals <br />and Geology. Karl Koehler represented the operator. The ground was wet and partially covered <br />with snow. Trapper has halted most reclamation work for the winter. , <br />ROADS <br />The following roads, their embankments, and adjacent ditches appear to meet design <br />specifications and are in good repair: North A Road, Mid A Road, Life of Mine Road, Ash Haul <br />Road, D Road, New #1 D Road, and the access and light-use roads in the Pyeatt, Grouse, and <br />Sage drainages. <br />HYDROLOGIC BALANCE <br />Sedimentation Ponds <br />Condition of Pond Embankments and Inslopes. Of the ponds inspected (see Table 1), none <br />of the dam embankments or inslopes showed signs of erosion and there were no signs of <br />differential settling. Cleaning operations last month had left the inslope on the east side of East <br />Pyeatt #1 pond too steep; the inslope has since been regraded to a gentler slope. EIk diversion <br />ditch #1 on the slope directly above the Elk pond has been regraded to give it better definition. <br />Pond Water Levels, Discharges, and Sediment Levels. As shown in Table 1, the ponds' <br />water levels and discharges have continued to drop from the high levels observed in September. <br />Trapper was finishing the clean-out of No Name #2. This is the last pond that needed sediment <br />cleaned out following the large rain on September 18-19. Now all ponds appear to have <br />adequate sediment storage capacity. <br />Drainage Channels. The operator has excavated a series of dozer basins in the disturbed area <br />in the channel of Oak drainage above Oak #1 pond. <br />BACKFILL AND GRADING <br />No problems were found in the ash disposal area. <br />TOPSOIL <br />Topsoil stockpiles next to ponds and roads were well-vegetated and did not appear eroded. <br />Markers were in place. <br />ALLUVIAL VALLEY FLOORS <br />Prior to arriving on the mine site, I inspected the area that currently is designated as the Flume <br />Gulch AVF. This area lies directly down Flume Gulch from the permit boundary and extends <br />from the Coy residence to the Talkington residence. I looked at this area to determine if a <br />stream channel could be found which meets the Division's regulatory definition given in Rule <br />1.04(142). <br />Page 3 <br />
