III. COMMENTS • COMPLIANCE <br />Below are comments on the inspection The comments include discussion of observations made <br />during the inspection. Comments also descnbe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a partial inspection conducted by Kent Gorham of the Colorado Division of Minerals <br />and Geology. This former underground mine is reclaimed. Remaining buildings and <br />structures are approved to remain as permanent structures. Ground conditions were dry <br />and the weather was warm. Mr. Albert luppa, landowner, visited with me prior to the <br />inspection. <br />Hvdroloaic Balance <br />The upper portion of the riprap section of Refuse Ditch No 1 requires some maintenance to <br />restore adequate freeboard and prevent gullies from developing along the side of the ditch. <br />Small rock in the center of the ditch could be better utilized lower in the ditch where larger <br />rock is more prevalent. Without maintenance, function of this ditch could be jeopardized. <br />The sediment pond held water just to the top of the primary riser. It appeared to have <br />discharged at some point in the recent past. Water in the pond was only slightly cloudy. <br />Goldfish and waterdogs were observed in significant numbers in the pond. <br />Processing Waste <br />The two photos below were taken one month apart and show the dramatic green-up of <br />vegetation on the refuse disposal area (RDA) due to the excellent growing conditions this <br />spring. The RDA appeared stable with no sign of slumps or damage due to the heavy spring <br />rain and snow. Contour ditches are holding up well along the refuse highwall with no <br />evidence of failure. Some sediment buildup was noted in these ditches and, as mentioned in <br />last month's inspection, during quarterly inspection these ditches should be checked for <br />excessive sedimentation that may lead to future breaching and erosion problems. <br />~~M~~-- <br />..
