III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />This was a complete inspection conducted by Joe Dudash of Colorado DMG. Basil Bear <br />represented the operator during the records check. No one represented the operator <br />during the field portion of the inspection. The only portion of the mine that is currently <br />active is the loadout. Mining has temporarily ceased. Business operations for Bowie <br />Resources are being shifted to the Bowie No.2 Mine facilities. Basil Bear's office is now <br />at the Bowie No. 2 Mine. <br />Mine ID Sims <br />Mine identification signs were present at the appropriate locations and contained the <br />correct information. Topsoil stockpile signs were also up. <br />Roads <br />All of the roads were passable and in good shape. The county is doing repaving at the <br />entrances to the loadout along Highway 133. <br />Sedimentation Ponds <br />There was no water in ponds 1, 2 and 4. Pond 3 had a little water in it. The gated valves <br />for ponds 1, 2 and 3 were open. The pond 4 gated valve was closed. <br />The pond at the loadout was dry as was the West Mine pond and the ROM pile pond. The <br />water level in the West Ridge waste pile pond was about 3 feet below discharge. The <br />bottom of the highway coal stockpile pond was wet. <br />All of the ponds had functional spillways and stable embanlanents. The pipe system that <br />carries pumped water from the highway coal stockpile pond to the coal loadout pond was <br />functional. <br />
