III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement acUOn. <br />This was an OSM Oversight inspection conducted by Kent Gorham and Jim Stark of the <br />Colorado Division of Minerals and Geology. Henry Austin of the Office of Surface Mining <br />(OSM) was also present for the inspection. As part of the 2004 Performance Agreement <br />between the DMG and the OSM dated April 2004, bond forfeited sites are being reviewed for <br />potential off-site impacts and comparison to findings from a similar oversight review in 2000. <br />This site consists of two separate reclaimed areas; a coal IoadouUtipple area and a portal <br />area, separated by a rocky ridgeline. Ground conditions on this day were dry and all areas <br />were accessible. Cows and calves were loafing <br />on the pond embankment, precluding detailed inspection of the pond. The pond typically <br />holds a reasonable amount of water. This disturbed area is relatively Flat and rill and gullies <br />were not observed. <br />
