Mr. Stephen Tibbals was to have met with us during the insp~tion; <br />however, he was not present when we arrived. The site fore n <br />accompanied the inspector for most of the inspection. <br />2.) Mining has progressed throughout most of Phase II; however, ~ond has <br />been submitted only for Phase I. The site is under bonded a this time. <br />3.) The approved permit maps do not reflect the present on-the-g ound pond <br />and mine configuration. Additional ponds have been construc ed without <br />Board approval. The Division specifically informed the oper for that <br />all design changes must be approved by the Mined Land Reclam tion Board <br />in our letter dated March 24, 1986 and this was acknowledged in a letter <br />from Mr. Ed Rich (dated April 3, 1986). <br />4. The permit boundary does not appear to be clearly marked and site <br />personnel apparently had no knowledge of permit requirements Our <br />inspection of September 11, 1985 recommended that the permit boundary be <br />staked and that permit documents be filed on-site. <br />5.) Some of the ponds are seeping and it is apparent that the pods have <br />discharged as evidenced by breeched berms and gullies extend ng from the <br />ponds. Recent sediment deposition has occurred downstream o~ the <br />ponds. The operator's letter of April 26, 1986, item number 4, <br />indicates that discharges will not occur from the ponds. <br />6.) Chemical and petroleum products are being stored in and around areas <br />flooded by seep water (below dam near trailer). Oil sheen i~ obvious on <br />this water. <br />7.) Some of the dams exhibit some possible cracking and evidence~of <br />instability. In particular, the empty dam/ponds to the Bout /s <br />8.) Tree slash is piled around the lower parts of the site. <br />9.) Please know that the above-listed observations may constitut violations <br />to Exhibit B of Permit Number M-85-022 and to C.R.S. 34-32-1 6(1)(h) for <br />failure to minimize disturbance to the prevailing hydrologic balance. <br />
