III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />any leakage, and appropriate repairs should be undertaken when the pond level is lowered. <br />The top of the 016 pond embankment had been recently seeded. The embankment <br />appeared stable, with no cracking or other indications of instability observed. The <br />french drain installed below the embankment to convey flow from the damaged <br />monitoring wells appeared to be functioning properly. <br />Grading had been performed to direct drainage flow in the native 006-S1 channel back <br />into the natural channel, rather than to the old temporary diversion above the "A" Road <br />Culvert. Some additional grading is warranted to create a more substantial bank, in <br />the immediate vicinity of the point of diversion for the former temporary diversion. <br />The capacity of the channel at the former point of diversion should be consistent with <br />the capacity of the native channel immediately above. <br />Repairs had been made to the breaches noted in the previous inspection on the lower <br />perimeter ditch in the Pond 17 watershed. The ditch will divert disturbed drainage <br />along the existing light use road into Pond 17, rather than allowing disturbed runoff to <br />enter Hubberson Gulch upgradient from the sediment pond. <br />Backfill and Grading <br />0 In the "D" Fit area, repairs were in progress along the lower segment of Drainage <br />Channel 005-E1. Hillslope gully repairs had been completed north of the existing <br />scraper road. <br />A D-10 dozer is being used to establish approved permanent drainage profiles and <br />eliminate nick-points along the drainages in the recently graded portions of the 006 <br />watershed, in the "A" Pit area. At the time of the inspection, the dozer was grading a <br />nick-point location on 006 Gulch, upstream from the oil well pad. Operator indicated <br />that the dozer will be kept on the channel construction project until it is completed. <br />Several hillslope gullies that were not included in NOV CV-2003-014, and which had <br />possibly formed this spring, were noted in recently topsoiled and seeded areas to the <br />north of the aspen test plots. One of the gullies was in the 2002 reclamation, a second <br />gully was further to the north, along an old scraper route on the north side of the 2002 <br />reclamation, and a third gully was approximately 50 feet north of, and parallel to the <br />second. Each of these gullies were deeper than one foot in some segments, and <br />appropriate repairs are warranted. It was noted from a distance that grading had been <br />initiated on at least one of these gullies prior to the conclusion of the inspection. <br />Slides and Damage <br />Several areas of sliding and settling in various disturbed area locations, which were <br />described in the previous inspection, were more closely assessed with the assistance of <br />
