III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />Stock Pond T22 remains full of sediment from last year. It is recommended that the <br />pond be cleaned out, to provide additional sediment control for the "D" Pit reclamation <br />during the early years of vegetation establishment. <br />A 24" CMP had been properly installed at the PM-4 site where the postmine road in the <br />"D" Pit area crosses the reconstructed 005 Channel. The road has not yet been <br />constructed to final alignment above this point. Operator indicated that a modified final <br />alignment was under consideration, which would eliminate one of the design <br />switchbacks, and reduce the disturbance associated with the road. Operator will need <br />to ensure that the modified design will be in compliance with grade limitations for a <br />permanent access road, and if such design change is to be pursued, a complete <br />technical revision application will need to be submitted promptly. <br />0 Necessary maintenance along the southern-most segment of the Haul Road "K" corridor <br />as described in the April inspection report had been completed. The slope below the toe <br />of the road fill had been graded, topsoiled, and seeded. Riprap installation appears to be <br />warranted along the road ditch outlet location in this vicinity. <br />0 Coal spillage had been properly cleaned up from the fill slope near the outlet end of <br />Culvert K-4. <br />Hydrologic Balance <br />Sediment Ponds 005, 006, and 016A were checked. Pond 005 water level was 1 foot <br />below the top of primary riser, and there was no discharge. <br />Pond 006 water level had been recently lowered (pumping to water trucks), and water <br />level was 12" to 15" below the tap of the riser. Operator had repaired the leak at the <br />extension joint 18" below the top of riser with crack sealant. The leak had been <br />reduced Yo dripping at less than 1 gpm of clear water. Operator indicated that the <br />pond will likely be dewatered later this summer to facilitate sediment excavation, and <br />that the riser section will be replaced at that time. This approach is acceptable to the <br />Division, as long as the leak remains at the present rate. <br />The inslope slumps at Pond 016A were inspected by Division engineer Byron Walker, <br />and his written observations will be forwarded to the operator upon receipt. Water <br />was at the level of the top of the primary riser at the time of the inspection, with some <br />inflow over the top of the riser; discharge was approximately 5 gpm of clear flow. A <br />trickle of discharge had been noted in the previous inspection, although at that time <br />water level in the pond was below the top of the riser. The pond level will be <br />significantly lowered later this summer to allow for investigation and (if necessary) <br />repair of the inslope slides.
