(Page 2) <br />MINE ID # OR PROSPECTING ID #: M-194A_()t 9 <br />INSPECTION DATE: 9/2F,/(17 INSPECTOR'S INITIALS: ~_ <br />OBSERVATIONS <br />1. This inspection was conducted as part of the Division of Minerals and Geology's monitoring program. Present at the <br />inspection were Kate Pickford, DMG and Richard Curry, Grand Gravel. Weather at the time of the inspection was partly <br />cloudy, calm, light rain, and approximately 60 degrees. <br />2. A sign was posted at the entrance to the site and the boundaries were marked. A crusher and heavy equipment were on <br />site, but no active mining was taking place during the inspection. The highwall of the pit in the northwest corner of the site is <br />relatively close to the permit boundary, making reclamation of the highwall difficult for access reasons. Mr. Curry indicated <br />that he was considering filing for a Conversion in order to expand the permit boundaries so that the highwall would not be <br />close to the boundary line. A topsoil stockpile was present on the site. Vegetation on the stockpile was somewhat sparse. Mr. <br />Curry indicated that he had seeded the pile with a mix, and the crested wheatgrass was the only species that was successful. <br />Mr. Curry further indicated that he would reseed the pile in the Fall of this year. Runoff at the site appears to be contained <br />within the permit boundaries. Noxious weeds were not present at the site. <br />3. An above ground diesel fuel tank was at the site near the scale area. The tank was sitting on the ground with no berm or <br />liner. Mr. Curry was advised that a berm and liner will need to be installed around and beneath the tank (see problem listed <br />on page 3 of this report). Additionally, some of the fuel had been spilled onto the ground in the vicinity of the tank. The <br />contaminated soil will either need to be removed, or dug up and periodically turned over to expose the fuel contained in the <br />soil so that the fuel can break down (see problem listed on page 3 of this report). <br />4. A large stockpile of sand was present to the south of the permit area. Mr. Curry indicated that he had moved the material to <br />that location in order to free up an area within the permit boundary which is covered with gravel, so that he could stack hay at <br />that location. Mr. Curry was advised that stockpiling the material outside of the permit boundary was in violation of the <br />Construction Materials Rules and Regulations (see possible violation listed on page 4 of this report}. A letter will be sent <br />separately indicating that there is reason to believe that a violation exists. The issue will be scheduled before the Mined Land <br />Reclamation Board at the November meeting. If the operator desires to rectify the situation prior to that date, the operator may <br />file for a Conversion, thus expanding the permit area to include the area where the sand pile is located. The Conversion <br />process, however, requires an amount of time which will exceed the meeting of the November Board meeting. Alternatively, <br />if there is undisturbed land within the permit boundary that is equal to the area occupied by the sand pile, which the operator <br />will continue to leave undisturbed, he may file an acreage release request for that portion of the permit boundary, and file an <br />amendment including that area where the sand is stockpiled in the permitted area. <br />5.
