ORIGINAL-PUBLIC FILE <br />(Page 2) <br />MINE ID # OR PROSPECTING ID #: nn_I9Rn-ICS <br />INSPECTION DATE: 8l~6/ns INSPECTORES INITIALS: ~;~ <br />OBSERVATION <br />The Division conducted a pre-operational inspection of the site on 8/26/05. <br />The operator, Rocky Mountain Materials has applied to amend the 112 permit <br />by increasing the permit area from41.37 acres to 295.00 acres. The <br />Amendment will add 253.63 acres to the permit area. Present during the <br />inspection was Mr. Tom Smith of Rocky Mountain Material. Prior to the <br />public Notice being published, the proposed application had received to <br />date approximately 19 timely objections. Most of the objections sited are <br />under local Government jurisdiction. The operation plans to expand the <br />current affected acreage by 10 acres from 41 acres to 51 acres. No ground <br />water will be exposed; it will be a dry operation. Operator plans to apply <br />for a well permit for any water that will be used during the washing of the <br />sand. The existing operation was mined and is still being utilized since it <br />was permitted in 1980, by E1 Paso County. This inspection mainly focused in <br />the proposed Amended area. The amended area including the existing permit <br />is completely fenced. <br />As Reported in the amendment application the area being added to the permit <br />is mostly flat with very little relief. It had a very good cover with <br />native grasses with some noxious weeds that were noted in some areas. The <br />entire amended acres were driven and inspected. Mr. Smith explained that <br />the operator tried to meet with the organizer of the objection letters but <br />the objector did not want to meet with them. He pointed out his house along <br />the south side of the proposed amended area, which is a good distance from <br />the amended area permit boundary. Initially the operator planned to place <br />an asphalt and concrete batch plants with in the permit area, however due <br />to different Rules and Regulations by the county for permitting such <br />facilities, Mr. Smith stated that for now those plans will be removed from <br />the Amendment application. During the inspection with the exception of an <br />existing well, with in the old permit area, a domestic or other well was <br />not noted. The closet house which utilizes a well is located a good <br />distance south of the permit. There is an existing radio tower with in the <br />existing permit area and power poles along the Eastern potion of the <br />proposed amended area, operator had agreed to obtain an agreement with the <br />man made structure owners or stay away the required safe distance prior to <br />mining near these structures, as required in the Rules. Amendment <br />application notice was properly posted on the fence, near the access road <br />to the existing permit. <br />
