Enforcement <br />action forthcoming. <br />1) Are mining out of sequences and are mining in area designated, Stage ZI and a portion <br />of Stage III This does not effect the final extent of mining. <br />2) Nave constructed a ditch along a portion of the southern boundary to help mitigate any <br />ground water depletion in adjacent properties which may be attributed to this operation. <br />3) The dam at the junction of Bu1Z Seep and the South Platte River has been re-en+~TCZCI <br />and one culvert has been installed. At time of this inspection the culvert was choked with <br />beaver cuttings. Culver placement will not allow the total drainage of Bu11 Seep at times <br />of low water and the water is very slow moving at the north end of the seep, green algae <br />is present on the surface. Operator stated that the dam was upgraded to increase water <br />fowl habitat and increase the ground water recharge to Ms. Ferguson's land. Operator did <br />not contact anu parties regarding the upgrading of this dam. <br />4J The operator is salvaging and stockpiling overburden (stockpiled along western Portion <br />of site) and topsoil. However the topsoil is being sold, rather than stockpile for <br />future use on the site. This is in contradiction to the approved permit (see page 4) <br />which states that approximately 250,000 cubic yards of organic topsoil will be utilized <br />in reclamation (see page 13). The overburden the operator stated he would use in <br />reclamation is of lower quality than the topsoil he is commited to use. <br />5) The operator has planted approximately 350 cottonwood trees and 50 Honey Locusts <br />along the northern portion of Stage O and Stage P last fall. The trees are from the <br />operator's on-site nursery. The cottonwoods have had poor to fair success (mostly alive <br />but not prospering), however, the honey locust are doing very well. All trees are irrigated. <br />The operator also planted grasses last fall (1980) without success (possibly due to lack <br />of moisture and competition with weeds). <br />6) Weeds are a problem on the site. <br />7) Operator attempted to plant trees in concrete enclosures, without success. Concrete <br />is along river embankment. <br />8) Operator has kept a 20-30 foot barrier between the southern fence line and his excavations. <br />This is not an undisturbed area as it serves as a road and in places has been cleared of <br />vegetation. <br />9) During my inspection it appeared that the operator is not maximizing his potential for `~ <br />concurrent reclamation and is handling overburden one too many times. It seems possible to <br />transport the overburden from currently worked stages to the mined out areas (portions of <br />Stages O 6 I) and construct the final slopes in these areas. <br />
