state that it had been done according to their records. It was <br />also noticed that the inspections were not being submitted by a <br />registered engineer. MLRD will require that all future <br />inspections will be submitted by a registered engineer. No ponds <br />are of a size that would require annual certification. <br />Certifications: <br />Maps and Plans--Zt was found during the review of mine <br />records that not all of the required maps and plans were <br />being prepared by or under the supervision of a registered <br />engineer. MLRD will require that these be resubmitted by a <br />registered engineer. <br />Impoundments--Sediment pond A is the only impoundment which <br />has been certified at this time. - <br />Diversions--All diversions presently constructed have been <br />certified. <br />Roads--The current Colorado regulations allow MLRD not to <br />require certification or design of roads and in this case it <br />was not required. This particular section is part of a <br />pending regulatory reform to make the Colorado regulations <br />at least as effective as the federal. MLRD is considering <br />requesting the operator to submit designs for the roads at <br />the mine since the permit is currently being revised. <br />The access road at the loadout facility is not shown as part <br />of the permit area. The condition of the road indicates it <br />is a private road. It is the Albuquerque Field Office <br />position that this road must be permitted prior to <br />commencement of operations at the facility. <br />Coal mine waste--None developed at this time. <br />Excess spoil disposal--NA <br />Subsidence Monitoring: MLRD has determined that subsidence <br />monitoring will not be necessary because there are no structures <br />or renewable resource lands within the affected area. <br />Recent permitting actions: There have been several technical <br />revisions and the latest have just been finalized. Completion of <br />review of all submittals will result in a new permit being <br />issued. <br />
