III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This was a complete inspection of the Seneca II Mine conducted on March 30, 2004 by Mike <br />Boulay of the DMG. Roy Karo of Seneca Coal Company (SCC) was present during the entire <br />inspection. Weather conditions were sunny and cool. Most of the mine site was damp from <br />recent precipitation. There were isolated azeas of drifted snow and some locations were saturated <br />from snowmelt and runoff. Other than the use of the shop and truck wash facilities, there was no <br />activity at the mine site. <br />Availability of Records <br />With the following exceptions, all required records were on file and available for review at the <br />Seneca II Mine office. See the attached records checklist at the end of this inspection report. <br />Please update the records file with the Midterm Review No. 4 dated 1999 and the Fourth Permit <br />Renewal Findings of Compliance Document. <br />Roads <br />Access to the site was limited to the Permanent Road accessing the Upper Wolf Creek azea and <br />the county road Leading to the Wadge Impoundment and Pecoco Pond. The lower portion of the <br />Permanent Road above the Wadge Impoundment was heavily rutted and had some standing <br />water. The site was accessible to the top of the former Wolf Creek Pit. All other mine site roads <br />were impassable due to very muddy conditions. <br />A significant gully has formed immediately north of the culvert crossing where Post Mine <br />Channel PM-6 flows beneath the Permanent Road above Post Mine Channel PM-1. Please repair <br />the gully or construct an adequately armored road drainage runout at this location. <br />There was flowing water in the ditches azound the two boneyazds. Culvert 53A located beneath <br />the access road to the New Boneyazd needs to be cleaned out and maintained. It was flowing <br />water at the time of the inspection, however, the inlet side is partially buried and the ditch needs <br />to be maintained and cleaned out on the outlet side. Please continue to maintain ditches, <br />culverts, and road drainage site wide. <br />Hvdroloeic Balance <br />Sedimentation Ponds 002, 003, the Truck Wash ponds, and the Pecoco Pond were inspected. <br />Ponds 002, 003, and the Pecoco Pond were full and dischazging cleaz water. The Truck Was <br />holding pond was neazly full but was not dischazging. Pond inlets, embankments and discharge <br />structures appeared to be stable and no problems were noted at these pond locations. Access to <br />Ponds 004 and C03 was not possible due to muddy and saturated road conditions. <br />
