III. COMMENTS - COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of <br />observations made during the inspection. Comments also describe any enforcement <br />actions taken during the inspection and the facts or evidence supporting the <br />enforcement action. <br />This was a complete inspection conducted by Tom Kaldenbach of the Colorado Division <br />of Minerals and Geology. No one else was present during the field portion of the <br />inspection. John Weinman of Montgomery Watson represented the operator during the <br />records check. <br />The ground was dry and the weather was warm. Both entrance gates were locked. <br />AVAILABILITY OF RECORDS <br />With the exception of a current public liability insurance certificate, all required <br />records were available at the Montgomery Watson office in Steamboat Springs. The <br />records checklist is attached. <br />REVEGETATION <br />Shrub transplants showed healthy looking growth in all three shrub parcels 003, HG- <br />8, and E. Shrubs in parcel E are much farther along in E than the other two parcels. <br />SLIDES AND DAMAGE <br />The steel stakes remain in alignment across the slump. Some of the slump area that <br />was redisturbed in summer 1998 during the under-drain installation is substantially <br />covered by grasses that have grown from seeding done in 1999, but approximately <br />4,000 square feet of the area has less than 30$ vegetative cover. The operator's <br />representative explained that seeding of those areas is scheduled for this year. <br />There was no evidence of discharge from the drain outlets. <br />Page 3 <br />
