III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />Coal Waste Disnosal Area <br />The gob pile haul road leading to the gob pile area had been watered and graded and was in very good condition <br />The road berm on one side and the road ditch on the other side had sufficient capacity. The material storage <br />areas along the gob pile haul road were in order. The sediment control along this road corridor was functional, <br />although a few spots will need some maintenance soon. The west portion of ditch D-E 1, behind and to the east <br />of the western most material storage area, could use some maintenance. Also, culvert C-El near pond C could <br />use a little cleaning. The straw bales at the west end of ditch D-D4 will need replacing soon. There was not a lot <br />of standing water in Pond C. The pond spillways were operational. Pond C had been cleaned out not too long <br />ago. Pond D was dry and had very recently been cleaned out. Pond D spillways were operational as well. The <br />inlet to culvert C-G3, which leads into pond D, will need some cleaning soon. <br />The haul road leading up to gob pile no. 1 was in good condition, although the road ditch and the Swale at the <br />gob pile entrance, functional for now, will need some maintenance soon. The operator has recently place coal <br />waste on the top of gob pile no. l .The top of the gob pile has positive drainage, the upland diversion ditch was <br />functional and the underdrain was exposed at the reaz of the gob pile, as designed. <br />The road leading up to gob pile no. 2 was passable and had been watered. The east and west upper diversion <br />ditches were functional, although some tree branches probably should be removed from one location along the <br />east diversion ditch. On the east side of gob pile no. 2, coal waste was sitting in small piles for drying. The <br />central and west portions of gob pile no. 2 were graded. Additional coal waste was being placed at the west <br />extension of gob pile no. 2. Ditch D-D15, along the south portion of the gob pile no 2 cove~ll stockpile will <br />need some deepening sometime soon. The ditch for now is functioning as designed. <br />The pump house was in order, but straw bales need replacing and more surface disturbance markers are needed <br />Unit Train Loadout <br />A loaded train was on site but there was no evidence of any fugitive dust. The loadout bench and spur track <br />bench were stable and well grassed. Both sediment ponds J and K were dry. Ditches and culverts in this area <br />were functioning properly. However, ditch D-K4 leading into pond K from the east could use a little <br />maintenance. The main topsoil stockpile was well vegetated. Topsoil signs were present. Mine ID signs were <br />also up. There were no problems with any of the facilities. <br />Hubbard Creek Drill Site <br />There was no activity at this site. The pilot hole has been drilled and a vent shaft will be constructed after <br />Division approval. Sediment control, including silt fence and straw bales, were in place. Mine ID signs, surface <br />disturbance markers and stream buffer zone signs were up. Silt fence was around the topsoil stockpile and <br />topsoil signs were present. The drill site entrance off of the Hubbazd Creek road was fenced off. The road was in <br />good condition. <br />Records <br />The records checklist shows that the mine records were in order <br />c:/word/bowie2/insp0607 <br />2 <br />
