III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This was a complete inspection conducted by Joe Dudash of the Colorado DRMS. Bill Bear represented the <br />operator during the field inspection and the records check. <br />Main Mine <br />The berm on the outside of the utility bench was in place. The utility bench cut slope was stable. The small slide <br />below the bench has stabilized for now but needs to be taken care of soon. The operator has an engineer looking <br />at the slide. The rock catchment berm was still functional, although no large rocks have fallen from the cliff <br />above. Ditch D-C 1 on the back side of this bench could use a little cleaning. There was some thistle to the back <br />of the bench which needs spraying. A weed spraying crew was onsite taking care of the noxious weeds. Surface <br />disturbance markers were up although could be used to the east of the light use road leading up to the bench. <br />The road was in good condition although the road ditch needs cleaning in spots. <br />The cut and fill slopes of the D-seam portal bench level were stable. There was only a small quantity of coal <br />stockpiled on this bench. There were no problems with any of the material storage areas and facilities on this <br />bench, including the fuel barn and explosives cap and powder houses. The ditches and culverts were functional <br />but some maintenance needs to be done. The inlet to the mine office upper parking lot culvert, C-C21, needs <br />cleaning. The three-culvert intersection at the entrance to the mine office upper parking lot needs cleaning as <br />well. Ditch D-C 12 behind the mine office lower parking lot also needs a little cleaning. The operator is planning <br />[o extend the inlet side of culvert C-C 13 behind the coal stockpile since it is prone to maintenance problems. <br />The operator continues to work on an upper area of the B-seam portal bench cut slope. The area was slumping <br />and affecting one section of the paved haul road above the bench. More work will be needed. The rest of the <br />haul road was in good condition. Road ditches had sufficient capacity although portions of haul road ditch D- <br />612, located two road turns above the main topsoil stockpile, need some cleaning. <br />The B-seam portal bench was well organized and neat. The upland diversion ditch had capacity. Water bars at <br />the B-seam portal bench excess material storage area need to be beefed up a little. The storage area is stable. <br />No problems were evident at the main topsoil stockpile. The stockpile was well vegetated and the collection <br />ditch and diversion berm were functioning properly. Topsoil signs were up. There were no problems at the <br />material storage area next to the main topsoil stockpile either. <br />Culvert C-B 13 at the lower water tank area needs some repair. There were no problems at the lower coal <br />stockpile pad, although [he straw bales at the top of the two down drains could use some changeover. There was <br />a small volume of coal that was stockpiled on the pad. There were no problems with fugitive dust going offsite. <br />The operator was watering the roads near the mine entrance. Mine [D signs were up, as were surface disturbance <br />markers. <br />The operator was cleaning out pond B. There was very little water in the pond. The pond embankment was <br />stable and the pond spillways were functional. <br />The wash plant was not operating during the inspection and the gob haul trucks were inactive. The small slump <br />in the cut slope behind the wash plant appears to have stabilized. Ditches and culverts were functional, although <br />the road ditch at the base of the wash plant stairs needs deepening. <br />
