(Page 2) <br />MINE ID # OR PROSPECTING ID rY M-1980-143 <br />INSPECTION DATE 6-:f0-2000 INSPECTOR'S INITIALS SSS <br />OBSERVATIONS <br />This was a routine complete inspection conducted as part of the Division's on-going monitoring plan for mine sites in <br />Colorado. This inspection was also conducted to evaluate current site conditions for use in updating the reclamation cost <br />estimate to determine if the current financial warranty is adequate. <br />The site was not active during the inspection, but has recently been operated. The highwall appears to be an estimated <br />60 feet longer than the approved 300 foot maximum length. Most of the highwall is approaching the 30 foot maximum <br />height. Neil's Excavation will need to conduct approved reclamation to reduce the length of the highwall to the approved <br />300 feet or less. <br />Sediment control structures at the site have not been maintained in functional condition. The sediment pond along County <br />Road 502 is non-existent and discharge from disturbed areas on the south west side of the site flow off-site without <br />treatment or settling. The settling pond along County Road 501 was discharging clear water from a recent storm. <br />However, if the site was active, this pond would not be adequately sized to remove suspended solids without use of a filter. <br />The approved straw bale filter for this structure was not in place. No sediment deposit was noted off-site. Neil's <br />Excavation will need to reconstruct and maintain these sediment control facilities to ensure no untreated stormwater is <br />discharged from disturbed areas of the site. It is recommended that silt fence be used across the outlets of the settling <br />ponds. Straw bales do not appear to last very long at this location. <br />The mine identificatior~ sign and affected area markers are in compliance. <br />There is an infestation of musk thistle on the reclaimed pit slope and above the highwall. It does not appear that the thistle <br />has been treated with herbicide. Neil's Excavation will need to perform weed control measures to remedy this problem, <br />and submit a weed control plan that will be implemented in future years to maintain control of weeds on the site, <br />particularly targeting noxious weeds such as musk thistle. <br />There are some piles of material that appear to have been imported and dumped on site. Some piles appear to be good <br />soil, while others consist of old broken concrete, fill dirt. Neil's Excavation will need to submit a notice, as required by Rule <br />3.1.5191 for any of this, material that will be used as permanent backfill on the site. <br />The reclamation cost e:Kimate for this site will be recalculated to update it using current cost references. The recalculation <br />will take place in the near future and will be forwarded to Neil's Excavation. Any required financial warranty, greater than <br />the current financial warranty amount, will need to be submitted and approved within 60 days of the mailing date of the <br />reclamation cost estimate. <br />Responses to this inspection report should be directed to Steve Shuey at the Division's Durango Field Office.
