III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a partial inspection of the Yoast Mine conducted on October 11, 2007 by Mike Boulay <br />of the DRMS. Dennis Jones of Seneca Coal Company (SCC) was present during the entire <br />inspection. Weather conditions were sunny and warm. According to SCC, a significant <br />rainstorm occurred at the Yoast Mine prior to this inspection. However, at the time of the <br />inspection ground conditions were dry. <br />Roads <br />The entire Yoast Mine site was accessible. Roads were dry and maintained. Haul Road B has <br />been narrowed. SCC has not yet requested that Haul Road B be retained as a permanent post- <br />mine feature. <br />Hydrolo~ic Balance <br />Sedimentation Ponds 010, 012, 013, and 014 were inspected. Ponds 010 and 012 were <br />discharging clear water. Ponds 013 and 014 were retaining significant amounts of water but were <br />not discharging. <br />Portions of two post mine drainage channels were damaged since the last inspection due to the <br />recent heavy precipitation. Channel YPM-16 above the Dragline Teardown area was eroded out <br />in the upper reaches of the channel. The riprap was washed out and the liner is exposed as <br />shown in Photograph Number 1. At Pond 014, the inlet (which is the lower reach of YPM-3-2) <br />was significantly damaged in the recent storm event. Photograph Number 2 shows fhe damaged <br />pond inlet with a gully exceeding 4 feet deep. YPM-16 and YPM-3-2 have been included in the <br />Phase I bond release application received by the Division on August 31, 2007. Please repair <br />these channels and ensure that they are constructed to the approved design specifications as soon <br />as practicable. <br />Post Mine Channel YPM-7 has also been damaged from recent rainstorms. As shown in <br />Photograph Number 3, a portion of the channel immediately above the point where it crosses the <br />former haul road is eroded. The riprap has been washed out and the liner damaged. To ensure <br />compliance, please maintain this channel to be stable and to function as intended. This specific <br />reach of Channel YPM-7 has been excluded from the Phase I bond release request. <br />
