(Page 2) <br />MINE ID # OR PROSPECTING ID # M-1979-097 <br />INSPECTION DATE 03/07/06 <br />INSPECTOR'S INITIALS ESC <br />This was an inspection of the East Rigden Pit, File No. M-1979-097 conducted by Erica Crosby <br />of the Colorado Division of Minerals & Geology. Eric Reckentine and Gary Knox of Lafarge <br />were present during the inspection. <br />The inspection specifically focused on the lateral berm that separates the East Rigden Pit <br />from the adjacent Port of Entry (POE) Pit operated by Lafarge (Permit M-1982-182). During <br />the Divisions previous inspection of 3/13/02 it was noted that the La Poudre River <br />breached the lateral berm that separates the pits during the flood of 1997-1998. <br />Floodwaters entered the East Rigden Pit on the northeastern edge and continued into the <br />POE Pit. A follow-up inspection occurred on January 13, 2004 that required the operator <br />to submit a technical revision to the permit to address how flood waters would pass <br />between the two pits. On April 1, 2004 the Division approved the technical revision (TR- <br />03) that stabilized the lateral berm between the East Rigden Pit and Port of Entry Pit. <br />The operator had until April 2, 2005 to install the stabilization measures noted in TR-03. <br />The Division has approved a number of extensions to either implement the approved plan or <br />submit a new later berm protection plan as requested by Lafarge (Lafarge previously <br />informed the Division that the landowner desires a different plan, which may involve <br />removing the lateral berm that separates the two pits.) Lafarge had until December 15, <br />2005 to implement the approved plan or submit a revised plan. A revised plan was never <br />submitted to the Division. <br />Backfilling of the adjacent POE pit was observed. In addition, the breached lateral berm <br />area has been partially graded and filled with dirt. It appears that the work in this <br />area to date is to facilitate the importation of inert fill rather than stabilize the <br />lateral berm. Based on the inspection, the stabilization plan has not been constructed as <br />approved in TR-03. Therefore, the Division believes this to be a possible violation of <br />C.R.S. 34-32.5-116(1)for failure to follow the approved reclamation plan.
