NWY. 5ectian 30, T22S, R46W, 6th P.M. <br />Water Division 2, Water District 67 <br />Dear Mr. Williamsen: <br />This letter is in response to your application for a substitute water supply plan for the <br />gravel pit awned by All Rite Paving and Redi-Mix, Inc. (All Rite), in accordance with 37-80-120 <br />C.R.S. Ttle required fee of $1,343 for the substitute supply plan has been paid. <br />According to information submitted, no portion of the lake surface was exposed prior to <br />January 1, 1981. You have calculated an antiapated net depletion to the Arkansas River for <br />this pit of 17.8 acre-feet per year for the 4.6 acres of lake surface exposed after December 31, <br />1980, and have provided a monthly breakdown of the April through March depletions. Your <br />estimate arssumed no evaporative loss during the period January 1 through February 14 due tc <br />possible ice cover. The February 1995 guidelines for gravel pit substitute water supply plans <br />state that evaporation will apply for periods when ice cover occurs, therefore we have adjusted <br />your evaporation amounts to include the January 1 through February 14 period, resulting in a <br />total evaporative toss of 18.8 acre-feet annually. <br />All Rite does not plan to mine any gravel from the Lamar Pit during 1996. Conse- <br />quently, no depletions are estimated for water-in-product, dust suppression, or concrete <br />hatching. The attached table details the monthly depletions for evaporation and provides <br />space for the calculation of other depletions, in case active mining operations at the pit are re- <br />sumed during the term of the substitute supply plan. <br />TFIe proposed source of replacement is 37.0 acre-feet per year of historical depletions <br />due to the use of 50 shares of Fort Bent Ditch Company stock. These 50 shares are a portion <br />of 60 shares which irtigated about 35 acres in Section 6, Township 23 South, Range 47 West <br />of the 6th P.M. This plan is deficient in that a site specific historic use analysis was not per- <br />formed and it does not provide for the dry-up of the acreage historically irrigated by the 50 <br />shares of Fort Bent Ditch. Any request for renewal of this plan must inGude either adry-up of <br />acreage, or additional proof that consumption by the remaining shares and water in the ditch <br />will not and can not be increased or expanded. <br />During periods when there are insufficient Fort Bent Ditch credits available to replace <br />the stream depletions, LAWMA will provide replacement water from sources available to it, <br />
