The issuance of the <br />permit does not assure the applicant that no injury will occur to another vested water right or preclude another <br />owner of a vested water right from seeking relief in a civil court action. <br />2) The construction of this well shall be in compliance with the Water Well Construction Rules 2 CCR 402-2, unless <br />approval of a variance has been granted by the State Board of Examiners of Water Well Construction and Pump <br />Installation Contractors in accordance with Rule 18. <br />3) Approved as a reversal of denial file no. AD-13759 pursuant to CRS 37-90-137(2) on the condition that this well <br />(gravel pit) is operated in accordance with the Lamar Pit substitute water supply plan approved by the State <br />Engineer on Sis~ptember 5, 1996. The well shall not be operated unless it is included in a substitute water supply <br />plan approved by the State Engineer or a plan for augmentation approved by the water court. The subject water <br />supply plan is currently valid through August 31, 1998, and if not extended or if a court approved plan for <br />augmentation i:; not in operation ,this well permit is null and void and diversion of ground water from this well must <br />cease immediately. <br />4) The average annual amount of ground water to be appropriated shall not exceed 48.86 acre-feet due to <br />evaporation with the total exposed surface area not to exceed 12 acres, or such lesser amounts as may be limited <br />by the controling substitute water supply plan or augmentation plan. <br />5) No water may be pumped from the pit. <br />6) The owner shall mark the pit in a conspicuous place with well permit number(s) and court case number(s) as <br />appropriate. The owner shall take necessary means and precautions to preserve these markings. <br />7) The boundaries: of the pond shall be no closer than 600 feet to any existig well. <br />8) The provision of the minimum construction standards in Rule 10 shall be waived for gravel pit wells except for <br />Rules 10.1 and 10.2.1 regarding aqu'rfer contaminants.
