<br />aINE ID # OR PROSPECTING ID # M-80-121 <br />INSPECTION DATE October 20. 1999 <br />INSPECTOR'S INITIALS TAS <br />Any desired changes or improvements to the approved plan should be submitted to the Division <br />for approval prior Co implementation. Such changes or improvements will need to be submitted <br />in the form of a technical revision. <br />5. There was a large topsoil stockpile, estimated to be 700 cubic yards, available for <br />reclamation purposes. Mr. Nelson indicated that there will be additional topsoil available <br />from the 10-12 acres to be mined. <br />6. Approximately 15-20 acres of the permit area was submerged at the time of inspection. <br />Depth of water was estimated [o be 3-4 feet. Accordingly, the water attracted a great <br />variety of waterfowl. The water appeared to be surface water collected in and along the Lone <br />Tree Creek drainage. Mr. Nelson indicated that 1999 was an exceptionally wet year with above <br />average precipitation during the past several months. This does not appear to be a concern <br />at this time. However, if the large volume of water persists for several or more growing <br />seasons, it may be necessary to have a field assessment by a representative of the Office of <br />the.SCate Engineer to determine if [he water is surface water or exposed ground water. <br />7. Several ring-necked pheasants were noted near the north permit boundary. <br />8. Mr. Nelson indicated that more than 365 days have lapsed since active mining last occurred <br />at the Pierce Pit. A recommendation for temporary cessation status was also given by the <br />Division in the previous inspection report (11/21/95). Mr. Nelson could not say when <br />extraction of the remaining 10-12 acres will occur since the site already contains several <br />or more large stockpiles of finished roadbase product. Since the current permit status is <br />"active", the Division considers this to be a problem that will require corrective measures. <br />In order to resolve this problem, the Division requests that the operator review the <br />requirements for temporary cessation as stated in the Construction Material Rules & <br />Regulations and file a notice on or before November 30, 1999 indicating the desired status <br />of the Pierce Pit. The notice should be for either active mining (excavation for at least <br />180 consecutive days per year), intermittant activity (please see attached Rule 1.13.7), or <br />temporary cessation (please see attached Rule 1.13.5).
