<br />III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcemen[ actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />This complete inspection was conducted by Joe Dudash of the Colorado Division of Minerals and <br />Geology. Mark Milner represented the operator. The mine site area was wet due to a recent <br />precipitation event. <br />Roads <br />The main haul road was in good shape. The road to the east side of the mine was in good shape also, <br />although the road was slippery. The same was true for the light use road to pond C. The road leading to <br />Elk Creek was in good shape. The road up. Elk Creek was very muddy but passable. The same was true <br />for the road up Beaz Creek. The Hubbazd Creek road was not passable due to a lot of deep mud and a <br />small slide across the road. No erosional problems were observed at these roads and at the emergency <br />drill site roads up A and C gulches. ~ ' <br />Facilities <br />No trains were loading during the inspection. No problems were observed with any of the facilities. <br />The amount of coal at the stacker tubes was down from last month. The longwall is in an area where <br />production is less than full capacity. There were no leaks at the fuel facility. The containment berm <br />was functional. <br />Hvdroloay <br />'~ The water level in pond B was up to the primary. the gate valve was closed. Pond C was dry. There <br />was a little water in the east yard pond and the substation no. 3 pond. The mine water pond had a small <br />.' discharge through the small discharge pipe. No problems with the water discharge were observed. No <br />erosional problems were seen with pond inslopes or outslopes. All spillways appeared to be functional. <br />There was one location in the road ditch, just west of the mine water pond, that needs some <br />maintenance. Due to the muddy conditions, a vehicle went off the road and into the ditch. At the <br />substation no. 3 location, the culvert under the road that leads to the substation itself needs cleaning. <br />Also in that same location, the ditch that goes around the substation has a low spot and is ponding <br />water. <br />The straw bales were up at the loadout SAE. The operator will be constructing pond Al at that location <br />Bonn. Straw bales and silt fence were in place along the entrance road to the mine site. There were no <br />
