III. COMMENTS -COMPLIANCE <br />Below are comments on the rnspecton. The comments include discusswn of observations made <br />durng the inspection Comments also descnbe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a partial inspection conducted by Kent Gorham of the Colorado Division of Minerals <br />and Geology. The weather was warm and mild and ground conditions were dry This <br />former underground mine has been idle or served as a loadout since underground <br />operations ceased nearly 15 years ago. Bobby Steele of Lorencito Coal Company and Ron <br />Thompson of Peak Project Management were present during the inspection. <br />Hydrologic Balance <br />Pond 7 held water to below the lowest row of holes on the primary riser. Pond 8 at the RDA <br />held water at about one foot below the top of the drop inlet riser Repairs at the emergency <br />spillway/primary outflow channel intersection remain to be completed. Pond 4 continues to <br />hold only a small amount of water in the southeast corner. <br />Processing Waste <br />Bobby Steele of Lorencito Coal Company was grading the operational surface of the refuse <br />Disposal area (RDA) located north of Highway 12 using a DB dozer material is being worked <br />to help facilitate drainage from this surface to the riprap downdrains that flank this valley fill. <br />Support Facilities <br />The operator was preparing to dispose of ancillary portions of the grasshopper conveyors <br />A large bench is being developed at the front of the RDA operational surface. Grade stakes <br />have been established to define the development of this large bench. This grading, when <br />completed, will split surface runoff approximately evenly between the east and west <br />downdrains It may also slow the deliver time of storm runoff and help prevent damage to <br />protected channels. <br />
