III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />The sediment control system was functional. Upland water was being passed through the loadout site <br />through the upland diversion culverts and ditches berms. Straw bales were in place across the railroad <br />tracks where the upland diversion water passes offsite. The disturbed azea collection culverts, ditches <br />and berms were also operational. There was no standing water in the sediment pond. The bin wall <br />embankment of the pond appeared to be stable. The gated primary discharge pipe valve was closed. <br />Highwav Coal Stockpile <br />This site was partially reclaimed so that there is no more coal stockpile on site. The footprint was <br />covered with soil. The graveled road into the site was in good condition. The mine ID sign was up at <br />the entrance. Surface disturbance mazkers were up as well. <br />There was a little ice-covered water in the sediment pond. The cut slope showed no signs of erosional <br />problems or slope instability. <br />East Mine <br />The entrance gate was closed and locked, with the mine ID sign up on the gate. The haul roads, the <br />access road to the higher benches and the light use roads were mostly covered in snow but were <br />passable. Road ditches were functional since there was only a small amount of rockfall in the ditches. <br />Road culverts were clear. <br />There have not been any recent reclamation activities on site. Most of the facilities have been removed. <br />There were no problems with any of the benches. Cut and fill slopes were erosionally and <br />geotechnically stable. The berms on the outside edges of the benches were functional. <br />There have not been any recent additions of coal waste to the west ridge waste pile. The collection and <br />diversion ditches and culverts associated with the waste pile were functional. There were no erosional <br />or geotechnical problems with the stockpile. There was only a little snow in the waste pile sediment <br />pond. The pond embankment was stable. The topsoil stockpiles were stable, although they could use a <br />little extra vegetative cover. Topsoil stockpile signs were up. <br />The four bin wall ponds were functiona[ as well. The bin wall embankments were stable and spillways <br />were operational. The last pond primary gate was closed, as required. There were no erosional <br />problems with the associated topsoil stockpiles, although they could use a little extra seeding. <br />Records <br />The records were found to be in compliance, as shown on the attached records checklist. <br />c:/word bowie I /insp11106 <br />2 <br />
