IlI. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This was a complete inspection conducted by Joe Dudash of the Colorado DMG. No one represented <br />the operator during the field inspection. Chad Isaman represented Bowie Resources during the records <br />check. Snow covered the higher elevations of the Bowie No. 1 Mine. <br />West Mine <br />The road from the Sylvester Gulch road up to the West Mine was covered in snow but was passable. <br />Road ditches and culverts were snow covered as well. <br />Most of the backfilled and graded former portal bench area was covered in snow. There were no signs <br />of slope instability or erosional problems. The mine ID sign was up, as were the surface disturbance <br />mazkers. Silt fence was also up. There was only snow in the two sediment ponds. Both pond <br />embankments were snow covered but appeared to be stable. <br />Well Field <br />The entire site was covered in 6 inches of snow. The entrance road was snow covered but passable. <br />The mine ID sign, topsoil stockpile sign and surface disturbance markers were present. No problems <br />were observed with the facilities and topsoil stockpile. <br />Run-of--Mine (ROM) Stocknile <br />The entrance road was snow covered, as were the road ditches and culverts. The mine ID sign was up <br />at the entrance and surface disturbance markers were up around the site. <br />The top of the remaining pile was snow covered. There was no evidence of ponded water on top of the <br />pile. The sediment pond only had a little ice-covered water in it. The pond embankment was covered in <br />snow but it appeazed to be stable. Culverts and ditches were also covered in snow. <br />Unit Train Loadout <br />All three entrances at this site were open, with mine ID signs up at each entrance. Surface disturbance <br />markers were up but more may be needed to better define the disturbed area. The surface disturbance <br />mazkers on the west side of the facilities bench need to be moved a few feet to the west to include the <br />collection ditch. <br />The paved entrance roads were in good condition. There were no problems with any of the facilities <br />and there were no Union Pacific equipment on site. There was no activity on site. <br />
