3 <br />III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />• TR-33 dewater pipe drill pad construction to begin tomorrow (10/17k drilling scheduled to begin <br />10/29 and to be completed within approximately 1 week. She indicated that the CDPS permit <br />amendment had been issued for the proposed dischazge site. <br />• A contract had been awarded for demolition of North Portal facilities, and remaining structures along <br />the overland conveyor (with the exception of the River Span tube and associated Transfer building #2). <br />The project is to begin November 1 and be completed by December 31. Demolition of the water tank <br />and certain other structures at the South Portal area was included in this contract. <br />• A contract has been awarded for demolition of the 2 West Portals substation and associated power <br />line, and removal of remaining structures from the South Fan site that had been placed along the road <br />to the 2 West Portals. The work is to be completed by the end of November. <br />Contractor bids are due October 24 for final reclamation dirt work associated with CRDA-2, CRDA-I, and <br />the Coal Creek permanent diversion. This would include final grading of CRDA-2, completion of the new <br />upper diversion, elimination of the existing upper diversion, placement of cover soil and topsoil and <br />wildlife habitat rocks, and completion of perimeter collection ditches. Similar work would be conducted on <br />CRDA-I, with the exception that the active bench area would be left open, to accommodate disposal of <br />coaly material from various mine areas during the course of reclamation. <br />October 25.2001 <br />Site was inspected in Ute early afternoon, with no operator contact present. Demolition work at the wash <br />plant facility has been essentially completed. Contractors were loading and hauling metal from one of <br />several rubble piles to the loadout during the inspection. As noted above, the shop building at the wash <br />plant has been left intact, due to the operator's belief that there is potential for future use of the structure. <br />The base of the coal stacker mbe was still intact. <br />There had been no further grading work at the CRDA 1 or CRDA 2 refuse areas since the previous site visit <br />on October 16. <br />At the North Decline, the drill pad for the new dewatering pipe drilling operation (TR-33) had been <br />completed, and soil and overburden had been stockpiled near Pond 7 as approved. <br />There had been no significant precipitation events in recent weeks, and drainage and sediment control <br />structures in the various facility areas appeared to be properly maintained. There was a shallow pool of <br />water in Pond 6. Ponds 4, 5, 7, 8, 9, 10, 11, and 12 were dry. <br />Tonya Hammond of PCC was contacted October 29 regarding the status of vazious scheduled reclamation <br />tasks. She indicated that demolition of 2-West Portals electrical facilities had commenced the week of <br />October 22, and that equipment had mobilized for demolition of the North Portal Facilities on October 26. <br />Necessary site preparation and survey work for the TR-33 drilling project had been completed. Drilling <br />was scbeduled to begin today (10/29/Ol), but Ms. Hammond indicated the drill crew had been delayed at <br />
