- Colorado MLRD reviewed Salt Creek Mining Company's PAP in accordance with <br />i the approved State program and the cooperative agreement. In <br />_.~/ coordination with Colorado NLRD's review, the Office of Surface Mining <br />• Reclamation and Enforcement (OSMRE) reviewed the PAP, including the <br />operation and reclamation plan portion of the permit application, <br />pursuant to the National Environmental Policy Act of 1969 (NEPA), the <br />Surface Mining Control and Reclamation Act of 1977 (SMCRA), the Federal <br />Lands Program, and the cooperative agreement, and provided its review <br />comments to the Colorado MLRD. <br />On May 23, 1985, Colorado MLRD submitted to OSMRE a decision package <br />containing the following: (1) a letter recommending approval of the <br />mining plan; (2) a Proposed Decision and Findings of Compliance Document <br />for the State's approval of the renewal of State Permit number C-004-80; <br />(3) a chronology of events relating to the processing of the PAP; and (4) <br />the State's permit document. The Proposed Decision and Findings of <br />Compliance Document was prepared by Colorado MLRD in accordance with the <br />cooperative agreement to assist OSMRE in the preparation of this <br />environmental assessment in compliance with NEPA and the guidelines of <br />the Council on Environmental Quality. <br />The regional impacts of coal mining in the West-Central Colorado Region <br />are addressed in the Bureau of Land Management's West-Central Colorado <br />Region environmental impact statement, 2981. Site-specific impacts of <br />the existing operations were discussed in the Environmental Assessments <br />`--- --- -` -`prepared by OSMRE in i9B2 -and Novemt~z _1.45 _ _ _ <br />-- <br />t_ J In conjunction with OSMRE's review of the PAP, OSMRE also reviewed the <br />~- prev'iously approved mining plan and the Federal permit number CO-0026 <br />issued on July 30, 1982 for the McClave Canyon mine. All terms and a <br />condition of the Federal permit will be covered by the Colorado permit <br />number C-004-80 and the mining plan approval document. Because the <br />Secretary of_the_Interior and the State of Colorado have entered into a <br />cooperative agreement which provides for the fnll delegation to the State <br />of the permitting responsibilities for operations on Federal lands <br />pursuant to Section 523 of SMCRA, the Federal permit will be dissolved <br />upon approval of this mining plan, as modified. <br />2. Alternati <br />Alternative 1, Approval Without Conditions--The Assistant Secretary <br />for Land and Minerals Management may approve the mining plan, as <br />modified, in accordance with the recommendation of the Colorado MLRD. <br />Alternative 2, Disapproval--The Assistant Secretary for Land and <br />Minerals Management may disapprove the mining plan, as modified. <br />This alternative would have the same effect as taking no action. <br />Alternative 3, Approval With Conditions--The Assistant Secretary for <br />Land .and Minerals Management may approve the mining plan, as <br />modified, with an additional special Federal condition beyond those <br />attached to the State permit by Colorado MLRD and the requirements <br />of the mining plan approval document. <br />-2- <br />
