The approved permit application states on page 8 of the Mine Plan (Exhibit D) that no more than 35 acres will be <br />disturbed at any one time. A copy of the 1:10,000 scale map of the disturbance areas indicates that there is a large <br />area of disturbance totaling 52.69 acres that is north and west of the "partially mined" area (see Mining Plan Map, <br />Exhibit C-1 ). The "partially mined" area was measured and found to be approximately 10.39 acres for a total disturbed <br />acreage of approximately 63 acres. Therefore, actual mining at this time disturbs approximately 63 acres. Haul road <br />disturbance, estimated from map measurements, totals an additional 1 acre ((1600 feet long x 30 feet wide) / 43,560 <br />square feet per acre). This is a problem since the existing bond probably does not cover this amount of disturbance at <br />this point and the presently approved permit does not allow for this much acreage to be disturbed atone time or in the <br />place that it is disturbed. The operator must file a change to the permit to allow this amount of disturbance in this area <br />by no later than September 30, 2005 or this could be considered a possible violation of CRS 34-32.5-116(1) for failure <br />to perform reclamation prescribed by the reclamation plan adopted pursuant to the Colorado Land Reclamation Act for <br />the Extraction of Construction Materials.
