III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />This was a complete inspection conducted by Mike Boulay of the DMG. Basil Bear and Dan <br />Bear of Bear Coal Company were present during the inspection. Reclamation and cleanup of the <br />Mine No. 3 site is continuing with good progress being made. The weather was cool and clear at <br />the time of the inspection. Ground conditions were slightly wet due to a recent snow storm. <br />Specific comments concerning the inspection aze presented below. <br />Availability of Records <br />Please update the records file with the 3rd quarter 1997 Subsidence Monitoring Reports and <br />Subsidence Monitoring Data. <br />Roads <br />The lower and upper portions of the Portal Bench Access Road have been reclaimed by returning <br />this azea to AOC. <br />Hydrologic Balance <br />The site pond was full but was not discharging at the time of the inspection. Some coaly material <br />has accumulated in the perimeter ditch west of the former Coal Storage Area. The operator will <br />remove this material from the ditch and dispose of it along with other excess spoil and <br />development waste that has accumulated at the site during the reclamation effort. All other site <br />ditches and culverts appeared to be clear of debris and functioning properly. <br />Groundwater was encountered during the excavation of the concrete foundation beneath the <br />stacking tube. Groundwater appeared to be approximately eight feet below the ground surface. <br />To facilitate excavation of the foundation. a small quantity of groundwater was pumped to the <br />site pond for treatment. <br />Backfill and Grading <br />No additional erosion or settling has occurred in the vicinity of the mine portals since the time of <br />the last inspection. However, some minor rockfall has occurted from the slope above the <br />reclaimed portal bench. The backfilled mine portals appeared to be stable. No discharge was <br />noted from the portal drains. The riprap drainage channel that has been installed in the area east <br />of the former portal #2 appears to be functioning properly to aid in drainage and reduce erosion <br />on the reclaimed hillside. <br />
