III. COMMENTS -COMPLIANCE <br />~ Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />this material as soon as possible, as the Division will include a <br />disposal cost in the estimate. There is a coal pile approximately <br />200-300 cubic yards which will need to be buried on site. We <br />discussed with Mr. White, the possibility of burying the material <br />as the backfilling is done on the tipple access. In addition, the <br />footprint of the coal stockpiles will need to removed and buried. <br />Mr. White discussed the possibility of retaining the sediment pond <br />as a permanent impoundment. Until the demonstration required by <br />the regulations is made and the pond is approved as permanent, a <br />cost to backfill the pond will be included in the reclamation <br />estimate. The portals at the sales site have been boarded up to <br />prevent access. The portals will not be accessible once the <br />operator removes the tipple and backfills the tipple access road. <br />' In addition, there is some loose material at the top of the portal <br />that will be cleaned up and stabilized when the tipple is removed. <br />We visited the TP-W1 monitoring well, which is planned for <br />reclamation once the Division has determined that well is no longer <br />needed. We also visited the site of the Calderola well which is <br />now owned by the town of Coal Creek. The operator occasionally <br />samples this well. <br />Reclamation Success <br />We visited three exploration holes permitted as a minor revision <br />under C-83-058. The three holes have apparently been sealed and we <br />located the rebar which marks the hole. <br />CEJ/068INS.126 <br />
