III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />A partial inspection of the Twin Pines No. 2 Mine and sales area <br />was conducted by Christine Johnston and David Berry of the <br />Division. Larry White, the engineer for the operator, accompanied <br />us during the inspection. The main focus of the inspection was to <br />conduct a thorough inventory of the remaining reclamation work to <br />be completed at the site in order to prepare a reclamation cost <br />estimate. The day of the inspection was clear and unseasonably <br />warm. Site conditions were dry. <br />Hydrologic Balance <br />Riprap has been placed in the refuse pile upper diversion ditch. <br />It appears to have been well placed in the ditch. Some grading <br />work is still required on the road to the substation and the road <br />to the refuse pile to convert them to ditches as required by the <br />reclamation plan. <br />Support Facilities <br />The observations regarding support facilities were made at the mine <br />site. There is miscellaneous equipment, scrap metal, and wooden <br />pallets on site which will need to be disposed of. Rough <br />measurements were taken of this material. We recommended that the <br />operator properly dispose of this. material as soon as possible, as <br />the Division will include a disposal cost in their estimate. There <br />are approximately 13 55-gallon drums most likely containing <br />hydraulic oil. We recommended that the operator dispose of the <br />drums in a proper manner, as the Division will include a testing <br />and disposal cost for the drums. The portals still require some <br />backfilling as the backfill does not begin until approximately 75 <br />feet back from the opening. In addition, the steel liner plate is <br />still in place in all three portals. The transformers at the <br />substation have PCB free stickers, but are difficult to read. The <br />truck trailer noted during previous inspections has been removed. <br />There is a concrete flume which is the outlet for the pond spillway <br />located in Lewis Gulch and will need to be removed. <br />Offsite Support Facilities <br />Observations regarding offsite support facilities were made at the <br />sales site. The office trailer and the shed by the office have <br />been removed from the sales area. We discussed the structures that <br />will remain on site. They include the well and well house and the <br />shack. These structures have been requested to be retained by the <br />landowner. A cost for removing the substation and powerline will <br />need to be included in the estimate. There is miscellaneous <br />equipment, scrap metal, and timbers on site which will need to be <br />disposed of properly. We recommended that the operator dispose of <br />
