IV. ENFORCEMENT ACTIONS
The following identifies enforcement actions taken during this inspection, the required
abatement and date of abatement for the violation, previous violations still requiring abatement
and the termination of violations cited during previous inspections.
On July 25, 1997, the Colorado Division of Minerals and Geology issued Notice of Violation
(NOV) CV-97-008 for damaged silt fencing and addition of silt and construction materials to the
stream in Sylvester Gulch; NOV CV-97-009 was issued on July 25, 1997 for failure to construct
the Sylvester Gulch Access/Haul road in a sufficiently stable manner to prevent damage to the
Sylvester Gulch stream channel; and NOV CV-97-010 was issued on July 25, 1997 for failure
to obtain regulatory approval for mine site construction activities including significant excavation
of previously undisturbed areas, prior to initiating construction activities.
These NOVs were issued as a result of observations made during a site inspection of the
Sylvester Gulch Facilities Area and Material Storage Bench azea on July 15, 1997. Details of
these observations are contained in the Coal Inspection Report dated July 25, 1997. The above
described NOVS are currently pending final resolution. MCC has successfully completed
abatement steps for NOV CV-97-008 and NOV CV-97-010, and these two violations were
terminated as of August 25, 1997.
No enforcement actions were taken as a result of this inspection.
