III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />Roads and Hvdroloaic Balance <br />Road surfaces and drainage structures appeared for the most part to be properly maintained <br />and functional. There were a couple small piles of spilled coal (a couple shovels full each) <br />along the road between the East Salt Creek bridge and the state highway, that need to be <br />cleaned up. <br />The "in-ditch" sediment trap above the sediment pond had been cleaned out during an <br />enforcement follow-up inspection I made on 11 /23/04. The culvert inlet sump associated <br />with the upper-most road culvert (on the collection ditch just down the road from the coal <br />stockpile area) had also recently been cleaned out. <br />The sediment pond had been de-watered, and the accumulation of coal fines at the pond <br />inlet area had been cleaned out. The failed sediment pond embankment had been <br />reconstructed and the primary discharge pipe replaced. Agate valve had been placed on <br />the inlet end of the pipe, and mechanism was being installed to allow for the valve to be <br />opened and closed when the pond is full. The material previously stored in the sediment <br />storage pile (from previous pond and ditch cleanouts) had been hauled to the approved <br />waste disposal area in the Munger Canyon Mine permit area. <br />A berm between the sediment storage area and the pond embankment had been worn down <br />due to work associated with embankment repair and material haulage, and will need to be <br />built back up. <br />Maintenance grading and seeding of the diversion segment south and west of the sediment <br />pond and sediment drying area/soil stockpiles location (described in the previous inspection <br />report) will need to be implemented in the spring, as soon as ground conditions permit. <br />A quantity of sediment has accumulated in front of the office area SAE sik fence, and <br />maintenance is warranted to remove the accumulation. <br />Portal area drainage and diversion culverts were clear and functional. Soil stockpile area <br />small area exemption silt fence installations were properly maintained and functional. <br />Support Facilities <br />Fill dirt from the construction material stockpile was used in the reconstruction of the <br />sediment pond embankment. When soils thaw and dry sufficiently, the disturbed portion of <br />the stockpile will need to be graded and seeded with the stabilization mix, as will the newly <br />reconstructed pond embankment and adjacent areas disturbed by the embankment <br />construction project. <br />
