III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations <br />made during the inspection. Comments also describe any enforcement actions taken during <br />the inspection and the facts or evidence supporting the enforcement action. <br />This aerial inspection was flown on January 9, 2001. The digital images were reviewed on <br />January l2, 2001. No compliance problems were observed during the overflight. There was some <br />snow in scattered locations around the mine site. <br />Roads <br />All of the roads were clear of snow and were passable. The operator watered a section of road <br />that included a portion of the mine entrance road and Old Highway 133. The road wash runoff <br />ran over the side of the Old.Highway 133 outslope and into the ditch leading into pond B. The <br />runoff was very black but all of it made its way into a nearly empty pond B. <br />Facilities <br />The downhill conveyor is in operation. The coal stockpile at the bottom of the hill and the coal <br />stockpile on the portal bench are fairly moderate in size now. A front end loader was being used <br />to load coal into haul trucks at the bottom of the hill. The outslope of the lower coal stockpile <br />bench is taking on a black hue, due to coal dust from the coal stockpile. A loading bin is in the <br />process of being erected a[ this site. Replacing a front end loader with a loading bin will cut <br />down the fugitive dust along Old Highway 133. <br />The operator has installed railing at the lower parking lot, the upper parking lot and around the <br />conveyor belt, as it goes underneath the outer edge of the portal bench. <br />Gob Pile <br />The operator has placed subsoil on the outslope of the second lift, as the lift progresses upward. <br />An excavator was on site, working on the outslope of the second lift. There were a few small <br />piles of coal refuse at the back of the gob pile, waiting for grading and compaction. There was no <br />ponding of water on top of the gob pile. <br />
