III. Comments -Compliance <br />Belor+ are comments on the inspection. The comments include discussion of <br />observations made during the inspection. Comments also describe any <br />enforcement actions taken during the inspection and the facts or evidence <br />supporting the enforcement action. <br />this was a compteLe rnspect,on of the Meeker Area dines conducted by .Susan <br />Morrison of CDhiG. Greg Lewicki of Greg Lrwicki and Associates, representing Enron <br />Coal Company, was present durius Lhe inspection. George A. °Bud" Rienau, Jr. and <br />George 1. kienau 3.1i, both land owners oi' the }Zienau #2 site, were present during <br />t,ie October 20, 1992 inspection of Lhe kienau #2 Miue site. 'fne purpose of the <br />inspection was to evalusLe reclamatron work for the purposes of performance bond <br />release on po:Lions of the mine sites. ~\eather co~,ditioas at the site were warm, <br />sunny, wind dry, <br />During the inspection of the kienau #'2 Minx., Lhe Rierrsus expressed that they were <br />not pleased \,•ith Lhe reclamation of their land. Specifically, Bud Rienau stated that <br />a developed spring had been covered dnring haul:filling operations. He also stated <br />Lhst he was unhappy with the type of vegetation replaced on his lsnd, and with the <br />lack of mati.,re shrubs. 'f he inspector explained to Mr. Rienau that it appeared that <br />reclamation of the site was performed in accordance with the approved reclamation <br />plan. <br />Mr. Rienau (Bud) also informed the llivis:on Lhat he and Enron Coal Company had <br />never reached an agreement regarding compensation for the use of his land or <br />rights of access. hlr. kienau slated Lhat until there was such an agreement, the <br />Division and/or representatives of Enron Coal Company would no longer have access <br />to his land. .1ttc•mpts to verify topsoil depths on the kienau s2 Mine on October 20 <br />and 22 were not successful since access to the land was denied. A request for <br />acccmpaniment from the Rio Blanco County Sheriff was declined. <br />Records wex•e inspected at the Rio Blanco County Courthouse. All required documents <br />were on file and current. <br />Signs and Markers were visible, well maintained, and displayed current information. <br />Hydrologic Balance: Due Lo recent dry conditions, no surface runoff was observed <br />at any of the sites. 'I he northern #1 sedimentation pond held water and was <br />discharging clear water at a rate of approximately i~ gallons per minute. The pond <br />constantly discharges since it receives groundwater inflows. A sample of the <br />discharge was taken to the Colorado llepartmenL of Health laboratories for an snal•ysis <br />of total suspended solids and pH. •f he Rr:fuse area sedimentstiou pond wss dry. <br />Rienau #2 Kline sedimentation pond A held water but was not discharging, pond B <br />was dry. <br />
