The possible violations should be <br />corrected by the dates given to reduce their severity when considered by the Mined Land Reclamation Board. The inspector noted <br />on the previous page should be notified of all corrective actions taken. <br />PROBLEMS/POSSIBLE VIOLATIONS <br />AND <br />CORRECTIVE ACTIONS <br />CORRECTION <br />DATE <br />1. Mine identification sign and permit perimeter markers were not observed. Rule 3.1.1211) of the Mineral Rules and Regulations <br />of the Colorado Mined Lend Reclamation Board requires the operator to post a sign at the entrance to the mina site, clearly visible <br />from the access road, which displays the name of the operator, the permit number, and a statement that a reclamation permit <br />for the operation has been issued by the Colorado Mined Land Reclamation Board. Rule 3.1.1212) states that the boundaries <br />of the affected area will be marked by monuments or other markers that are clearly visible and adequate to delineate such <br />boundaries. <br />CORRECTIVE ACTION: Post mine identification sign and permit perimeter markers for the mine site and the processing plant, <br />as required by Rule 3.1.12111 end 121. Signs and markers are required to be maintained by the operator until DMG approves <br />complete release of performance and financial warranty and termination of permit. <br />11 /20195 <br />PB or PV PB <br />TOPICISI SM <br />2. The current amount of financial warranty was set by the Colorado Mined Land Reclamation Board on 5/26/83. Rule 4.2.1111 <br />of the Mineral Rules end Regulations of the Colorado Mined Land Reclamation Board states that ALL financial warranties shall <br />be set and maintained at a level which reflects the actual current cost of fulfilling the requirements of the reclamation plan during <br />site closure and reclamation. Section 3 4-3 2-1 1 011 11d1111 of the Act states, "A financial warranty may be required to be posted <br />by the mine operator, which warranty shall not exceed one thousand five hundred dollars..." Review and recalculation of the <br />required bond for reclamation of this operation will take place over the next few weeks. A detailed estimate of the recalculated <br />cost, based on the approved mining and reclamation plans and conditions observed during the inspection, will be forthcoming. <br />CORRECTIVE ACTION: Pursuant to Rule 4.2.1121, if DMG determines that the amount of financial warranty is insufficient to <br />perform reclamation, the operator shall have up to sixty 1601 days to post additional financial warranty from the date of written <br />notice from DMG of such insufficiency.
