III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a complete inspection conducted by Kent Gorham of the CDMG. This coal <br />operation is currently under a temporary shutdown due to market conditions. The first permit <br />renewal (RN-01)was approved with conditions on November 6, 2003 and is in the 30-day <br />public comment period. Only maintenance activities have taken place since the last <br />inspection. The weather was cool and windy and ground conditions were dry. Mr. Bobby <br />Steele of Lorencito Coal Company was on-site on this day and accompanied me on the <br />inspection. <br />Availability of Records <br />The public copy of the mine records has been moved from the Tri-State railyard office to the <br />office of Peak Project Management (PPM). The contact, address, and phone number for <br />PPM is Ron Thompson, Peak Project Management, 34115 County Road 20.8, Trinidad, CO <br />81082, 719-846-4975. All records were found in compliance as detailed on page 2a of this <br />report. <br />Signs and Markers <br />The mine identification sign is clearly visible just south of the entrance road after crossing the <br />bridge over the Purgatoire River. All signs were found in compliance with Rules 4.02 and <br />4.08. The operator should place topsoil markers on the piles temporarily stockpiled on the <br />western boundary on the disturbed area prior to the next inspection. <br />Roads <br />The first two culverts ascending the Jeff Canyon haul road were found cleaned at their <br />respective inlets. Small sumps have been installed immediately prior to the inlets to <br />accumulate sediment. As mentioned previously, a culvert is necessary on the Lorencito <br />Canyon haul road south of its intersection with the Jeff Canyon haul road. Diversion of flow <br />to the south to Jeff Canyon in the western road ditch has not been successful due to the <br />existing grade of the road. Instead, water flows to the north in this ditch and flows across the <br />road surface of the Lorencito Canyon haul road at the intersection. <br />The light use road to pond 8 requires some grading to remove rocks and debris that has <br />sloughed from the cut slope above the road. <br />Hydrologic Balance <br />All ponds at the site were visited. No discharge was observed at any of the ponds. Most <br />ponds held some water, with significant water noted in ponds 5 and 10. Sediment markers <br />have been established in all ponds except ponds 5 and 6. Ditch D96 was cleaned along its <br />entire length and found in excellent condition. <br />
